Fixed Price House and Land Packages Terms and Condition

Terms and Conditions

Effective Date: 22 November 2008

1.       Marketing by HPG Property Management Services Pty Ltd (HPG). Land developed and sold by the Calvary Temple Assembly of God Townsville Trustee for Calvary Temple Foundation ABN 26 986 485 016(Developer).
2.       None of the Builders participating in the Montana fixed price home and land packages (“home and land packages”) are subsidiaries or related entities of HPG Property Management Services Pty Ltd the Developer.
3.       The home and land packages are available from 22 November to 30 January  2009 unless sold beforehand.
4.       The Homes and Land forming part of the Home and Land Packages are sold separately. HPG is responsible for the sale of the Land only on the terms of the Developer’s standard land contract (“land contract”). Anyone wishing to purchase a home and land package (‘purchaser’) will need to enter into a separate building contract with the relevant builder (“builder”) for the construction of the home (“building contract”).
5.       HPG and the Developer make no representations and give no warranties about a Builder’s ability to enter into and/or perform a Building Contract, for any representations made by a Builder or for any loss suffered by a Purchaser or any other person in any way arising out of or relating to a Building Contract; the failure of a Builder to enter into a Building Contract and/or the construction of a Home.
6.       Fixed Prices are based on the relevant Builder’s standard specifications and inclusions (Purchasers should obtain copies from the Builder) and each Fixed Price includes the  Montana Fixed Price inclusions i.e. Land, floor coverings, turf to front, driveway and letterbox, boundary fencing to half. The floor coverings, turf, driveway . letterbox and fencing are inclusions in the Building Contract not the Land Contract.
7.       Fixed prices do not include stamp duty on the Land Contract or the Building Contract, registrations fees (including registration fees in relation to the transfer of the Land), local government change in ownership fees and any other fees or charges relevant to the acquisition of land or a house or the construction of a house. Purchasers will need to pay these fees and charges separately.
8.       Fixed prices do not include legal fees or the costs of other services which may be required by a Purchaser in relation to the Land Contract, the purchase of the Land, the Building Contract or the constructions for the home. Purchasers will need to pay these fees and costs separately.
9.       Fixed prices are correct as at 22nd of November 2008 but may change as a result of variations in the inclusions or the specifications of the Home required by Purchasers and changes in local, state or federal government laws or requirements which affect the inclusions or specifications of the Home. The land price is subject to adjustments under the land contract.
10.   To obtain the benefit of the Home and Land Package, Purchasers must enter into the Land Contract with the Developer between 22 November and 30 January 2009 inclusive and a Building Contract with the relevant Builder for the Home which is (or has become) unconditional in relation to the Purchaser’s obligations  within 21 days of the Land Contract being entered into. Purchasers who enter into Land and/or Building Contracts outside these timeframes are not eligible for the Montana fixed price home and land packages.
11.   Home and land packages are only available for the specific home and land combinations advertised. Purchasers are not able to choose alternate homes or land under the home and land packages. Each home and land package is unique and is only available until sold. HPG and the Developer make no representation and give no warranties that home and land packages will be available for the duration of the home and land packages promotion.
12.   Alterations may be required to the homes in the promotional material to ensure they comply with any building covenants applying to the land. Purchasers should satisfy themselves regarding the compatibility of the home with the building covenants.
13.   Photographs and illustrations in the promotional material are intended to be a visual aid only and may show items or inclusions which do not form part of the Home and Land Packages. HPG and the Developer give no warranty and makes no representations as to the accuracy or sufficiency of any description, illustration, photograph or statement contained in any of the promotional material.
14.   HPG and the Developer will not be liable for any loss or damage or personal injury suffered or sustained by any person who relies either wholly or in part upon the information contained in the promotional material in relation to the home and land packages or participates in the promotion except for any liability which cannot be excluded by law.
15.   Purchasers of New Haven Homes and Vista Homes packages will receive a $10,000 rebate upon settlement of their contract. The prices advertised for these packages are inclusive of the $10,000 rebate. Land Contracts for these packages will incorporate the rebate as a rebate off the full retail price of the land at settlement.
